TRADING AGREEMENT

This revision is effective from 15th November 2006.

These rules apply to everyone posting in the CitiSouk.com forums, whether they are the originator of a post or replying to an existing one. These rules are necessary to avoid confusion, and protect the rights of all parties in any transaction that is executed through CitiSouk.com (CitiSouk).

1. General Conditions

By posting in this forum you agree to abide by all of the rules of this forum and not to enter into any disputes with moderators, whose decision is final. Moderators of the Forum are empowered to, at the very least:

Impose a trading ban on members found to be breaking any rules of this forum.

Remove any posts in any forums questioning/disputes any decisions made by moderators.

Terminate your CitiSouk Account. (The penalty for breaking any of the following rules will be at the discretion of the moderators and will vary from a warning or a temporary trading ban, to permanent exclusion from CitiSouk).

2. Selling Items on CitiSouk.

It is your responsibility to describe the goods accurately. Be totally honest about the quality of your product, and post pictures where ever possible (even ones from a mobile phone are better than nothing).

If you misrepresent the condition or history of the goods, then the purchaser is within their rights to demand a refund and return the goods at your expense.

CitiSouk is not an auction site. As a seller you must clearly state your asking price. Potential buyers are then free to make offers on that asking price.

The Moderators of the CitiSouk will endeavor to resolve any trading disputes, and their rulings are final.

If a CitiSouk Moderator find you to be at fault in any way, and you do not make good on the trade, you will be permanently banned from the forums.

Advertising stolen goods, pirated DVDs/games will not be tolerated, get the advertiser an instant and permanent forum ban.

All sale posts must state if the price includes postage (if any) or not. If your post does not specify whether or not postage is included it will be assumed that you're asking price does include delivery.

3. Making an offer on CitiSouk

All offers must be made directly on the forum to the seller. You cannot make a higher offer after an offer by another trader has been accepted on the forum.

4. Direct Contact between Traders

Personal Messaging on CitiSouk and email may not be used at anytime during a live trade. CitiSouk is built around openness and transparency between all traders, and as such all discussions including questions, offers, acceptances and refusals should be shown clearly in the thread. Once a sale is complete you may use whatever form of external communication you like to finalise payment details including confirming exchange location, and contact details.

5. Negotiations.

If a seller and a potential buyer are in dialogue over the price of the goods and the seller decided to reduce their asking price for that potential purchaser, that price becomes the new asking price for all potential purchasers. However, the potential purchaser in dialogue has a 2 hour period in which to agree to that offer before other parties may 'jump in' offering that new price to secure the sale.

6. Request Posts.

When making a Request for a product be very clear about exactly what you are looking for, refer to model numbers where appropriate and state what the minimum acceptable condition of the product is.

If you are seller and wish to respond to a request then you must do so in open to the forum.

7. Reporting Problems

If for any reason you are unhappy with the behavior of a particular member, or feel someone is breaking the rules, you can refer it to a moderator by selecting the small red triangle ( ) next to the relevant post or the members name.

8. Closing Adverts

If you are a initiator of the thread and have successfully agreed a trade with a someone then you should make this clear on the forum – for example – "I have accepted Johns offer and close the thread. If you wish to cancel the trade then close then simply close the thread.

Spoiling Posts

If you see any rule infringements, we would appreciate it if you would report these to the moderators by clicking the small triangle under the poster's name. Please do not post comments in the thread as this will be considered to be spoiling the post.

You should only post on the forum if you are interested in engaging in the activity of buying or selling a product.

9. Your Responsibilities

All traders will be expected to visit CitiSouk to deal with their trades on a frequent basis.

CitiSouk moderators and staff, do not accept any liability for any form of loss incurred from the use of the forums. If you are a victim of any activity you feel is illegal, or unethical, please report this to a Moderator.

When trading on CitiSouk we strongly recommend that you adopt the following best practices:

1. We encourage face-to-face meeting but you must ensure you meet in an open, public space - our suggesting Exchange Zones would be a good start.
2. Request digital photographs of the goods you are purchasing if they are not provided.
3. Insist on insured delivery and make claims against that insurance where items are damaged or lost in transit.
4. Obtain and verify the details of the person you are trading with by, for example, calling them on their landline or mobile.
5. If you are transferring monies via bank transfer or any other electronic means, check that the name and location of the receiving account matches the detail you have about the seller and get proof of the transaction.
6. Always leave feedback after each trade for the other party whether it's positive or negative.
